Intellectual Property Protection: All pre-existing frameworks, methodologies, and diagnostic tools remain the sole IP of the Advisor, as defined in the Strategic Advisor Scope of Work and contract for service.
Q: Is the strategic advisor an employee or an independent contractor?
A: Engagements are structured strictly as a Contract for Service under the Malaysian Contracts Act 1950. The Advisor acts as an independent contractor responsible for their own tax filings and is not entitled to statutory employee benefits (EPF, SOCSO, EIS).
Q: Are statutory filings included in the advisory scope?
A: No. The Advisor provides strategic guidance, frameworks, and oversight. Statutory accounting, auditing, tax filings, and formal legal work remain the direct responsibility of qualified professionals engaged by the Client.
Q: How are proprietary frameworks and KPIs protected?
A: Pre-existing methodologies remain the exclusive property of the Advisor. Detailed diagnostic criteria and the proprietary 7 Health-Check KPIs are disclosed only under a signed Mutual Non-Disclosure Agreement (NDA).
